Whilst ESOS phase 2 notification deadline of 5th Dec 2019 may seem some way away, companies need to establish now whether they will be in-scope on the compliance date of 31 December 2018 (this year) and what they need to avoid facing the prospect of prosecution and fines of up to £50,000. Companies will be in scope if they are  >250 employees or turnover > £38M and Balance Sheet > £33M. So if you think you are going to be caught it is sensible to act now and give yourself time on how you should act.

But organisations subject to ESOS, but not meeting the requirements, face three levels of enforcement action by the Environment Agency;
1. Compliance notice – requesting information about eligibility for ESOS,
2. Enforcement notice – telling you what you must do – and by when, to comply, and finally
3. Penalty notice – imposing civil penalties

It is our opinion that the Environment Agency are likely to take a less lenient approach than in phase 1 and prosecute companies for failing to comply – having first satisfying themselves that a firm is in scope.

ESOS assessments carried out by ARC support the assertion by the Carbon Trust and Energy Saving Trust that significant savings can be made in most organisations with some investment. Energy savings opportunities identified in the exercise have been quite remarkable, with gas use for heating one area that we have seen as providing the most robust business cases and shortest payback.
