Whilst the ESOS notification deadline has now passed (5th Dec 2015), in-scope companies who have failed to notify are now facing a prospect of prosecution and fines of up to £50,000. All companies already deemed by the Environment Agency (EA) to be in scope (i.e. >250 employees or turnover > £38M and Balance Sheet) have been written to by the Environment Agency. So if you have a letter from the EA and not notified your EO compliance consider yourself in their crosshairs!

But organisations subject to ESOS, but not meeting the requirements, face three levels of enforcement action by the Environment Agency;
1. Compliance notice – requesting information about eligibility for ESOS,
2. Enforcement notice – telling you what you must do – and by when, to comply, and finally
3. Penalty notice – imposing civil penalties
An extension was available to end of January – but only if a “notice to comply” was returned by 5 Dec.

So now the Environment Agency is entitled to start prosecuting companies for failing to comply – having first satisfying themselves that a firm is in scope.

However, ESOS assessments carried out by ARC support the assertion by the Carbon Trust and Energy Saving Trust that significant savings can be made in most organisations with some investment. Energy savings opportunities identified in the exercise have been quite remarkable, with gas use for heating one area that we have seen as providing the most robust business cases and shortest payback.
